These Terms of Service (“Terms”) govern your use of https://justanotherpawnmedia.com (the “Site”) and the video production, social media, content, and digital marketing services offered by Just Another Pawn Media (“JAP Media,” “we,” “us,” or “our”). By using the Site, booking a call, downloading a resource, or hiring us, you agree to these Terms. If you do not agree, do not use the Site or our services.
1. Who we are
Just Another Pawn Media is a Texas limited liability company based in New Braunfels, Texas. We serve businesses in New Braunfels, Austin, San Antonio, and surrounding areas, and may work with clients elsewhere by agreement. Contact: japmedia@justanotherpawnmedia.com • (737) 316-5933
2. The Site is informational
The Site describes our services, packages, process, and selected results. Package prices, deliverable ranges, and examples on the Site are starting points, not a custom contract. A paid engagement starts only when both sides agree in writing (email is enough) and any required onboarding or first invoice is handled. Past client results, view counts, and testimonials are real work from specific engagements. They are not a promise that your business will get the same numbers.
3. Free 30-minute strategy call
The free consultation is a 30-minute strategy conversation. It is not legal, tax, or financial advice. It is not a commitment to hire us and we are not obligated to take every project. Booking is handled through SavvyCal at https://savvycal.com/japmedia/strategy. Please cancel or reschedule if you cannot attend. Repeated no-shows may lead us to decline future bookings.
4. Services
Depending on the agreed package or project, services may include: • Video production and editing • Organic social media management • Creative content and captions • Digital marketing strategy • Related consulting. We do not guarantee follower counts, viral posts, search rankings, ad performance, or a specific amount of revenue. Marketing results depend on your market, offer, reviews, response speed, budget, and how quickly you give feedback and access.
5. Client responsibilities
You agree to: • Provide timely access, brand assets, feedback, and approvals • Make sure you own or have rights to everything you send us • Be truthful in claims we are asked to put on camera or in captions • Pay invoices on time • Keep platform logins secure and revoke access when a project ends. Delays on your side can delay delivery. That is not a breach by us.
6. Fees, minimums, and refunds
Current starting packages and onboarding fees are listed on the Pricing page and may change. The price that governs your work is the price in your written agreement or accepted invoice. Unless we agree otherwise in writing: • Monthly packages have a 3-month minimum so the system has time to work • After the minimum, either side may continue month to month • Soft guarantee: if the engagement is not the right fit after the first 30 days, we will refund the unused portion of that first month • Onboarding fees cover setup and are generally non-refundable once work has started • Late invoices may pause production
7. Intellectual property
You keep ownership of your trademarks, footage you supply, and your pre-existing brand assets. Until invoices for a deliverable are paid in full, we retain all rights in the work product. After payment, you receive a license to use the final approved deliverables for your business marketing. Unless we agree otherwise, we may display finished work, behind-the-scenes stills, and non-confidential results in our portfolio, website, proposals, and social channels. We keep ownership of our templates, internal systems, shot lists, processes, presets, and know-how.
8. Content standards and platform rules
We create platform-aware organic content. Platforms change their rules. We do not control Instagram, Facebook, TikTok, YouTube, or any other network and are not responsible for account flags, reduced reach, outages, or policy changes. You are responsible for the underlying claims about your business. We may refuse work that is illegal, deceptive, or outside the scope we agreed to.
9. Lead magnets and emails
If you request a checklist or similar resource, we may email it to the address you provide. Transactional and service emails are part of doing business with us. You can unsubscribe from optional marketing emails.
10. Acceptable use of the Site
You may not: • Scrape, copy, or republish the Site to build a competing service • Attempt to break, overload, or probe the Site • Submit false booking information • Use the Site for unlawful activity
11. Third-party services
The Site may link to SavvyCal, social platforms, and other tools. Those services have their own terms. We are not responsible for their pages or outages.
12. Disclaimers
THE SITE AND OUR SERVICES ARE PROVIDED “AS IS.” TO THE MAXIMUM EXTENT ALLOWED BY TEXAS LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted or error-free.
13. Limit of liability
TO THE MAXIMUM EXTENT ALLOWED BY LAW, JUST ANOTHER PAWN MEDIA AND JUAN A. PEREZ ARE NOT LIABLE FOR LOST PROFITS, LOST DATA, LOST BUSINESS, OR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SITE OR A SERVICE ENGAGEMENT IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SPECIFIC SERVICE THAT GAVE RISE TO THE CLAIM IN THE THREE MONTHS BEFORE THE CLAIM. Some states do not allow certain limits. In that case, the limit applies to the fullest extent allowed.
14. Indemnity
You agree to indemnify and hold harmless Just Another Pawn Media and its owner from claims that arise out of your misuse of the Site, content you supplied, or your breach of these Terms.
15. Termination
You may stop using the Site at any time. We may stop offering the Site or refuse service if these Terms are violated or if a project is not a fit. Paid work already delivered remains payable.
16. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Exclusive venue is the state or federal courts serving Comal County, Texas, unless both sides agree in writing to another forum.
17. Changes
We may update these Terms. The “Last updated” date will change when we do. Continued use of the Site after an update means you accept the revised Terms. A signed client agreement controls if it conflicts with the Site Terms.
